As part of the ACT Government’s Open Government commitment, this document is a public summary of matters considered by Cabinet.  It is not intended to be a detailed set of minutes and does not cover all matters considered by Cabinet.  Among the matters not covered are materials considered in the formation of the ACT budget, commercial and industrial matters under negotiation as well as matters that would impact personal privacy, security and the ACT economy.  Nothing in this document can be considered a waiver of the Government’s executive privilege.

Committees of Cabinet

Prior to Cabinet meeting, a meeting of the Urban Development Committee was held.  Officials joined with Ministers to discuss matters of development and planning significance.

Extending Through Care for Offenders in the Community

Cabinet agreed to extend the Throughcare policy framework, which supports offenders’ reintegration into the community.  The framework seeks to recognise the diverse and complex needs of prisoners during transition.  It focuses on establishing seamless service provision with a view to reducing the risk of reoffending behaviours.  A discussion paperimg-icn-extlink has been released canvassing the options for further developing an extended Throughcare system that ensures continuity of service delivery beyond the corrections setting.

Territory Partnership with AFL (Giants) – Final Contract

Cabinet agreed the Minister for Tourism, Sport and Recreation execute the contract with the Australian Football League, re-affirming the ACT’s commitment to partner with the AFL and Greater Western Sydney Football Club (the Giants).  The Heads of Agreement and subsequent contract between the parties will be publicly released on the ACT Government Contract Register once executed.

Crimes Legislation Amendment Bill 2011

Cabinet agreed to introduce the Crimes Legislation Amendment Bill 2011.  The Bill amends the Crimes (Sentencing) Act 2005, Crimes Act 1900, and Criminal Code 2002.  The amendments allow a court to give consideration to whether the victim of an assault was a member of a vulnerable or ‘at-risk’ occupation (such as policing or emergency services) when handing down a sentence. The Bill also amends the law on self-defence to limit the availability of self-defence as a defence for people who assault police in the course of an arrest, or while under police restraint.

Public Release of the Final ACT Waste Management Strategy 2011-2025: Towards a Sustainable Canberra 

Cabinet agreed the ACT Waste Management Strategy 2011-2025: Towards a Sustainable Canberra.  The Strategy focuses on the four key outcomes of:

  • generating less waste;
  • full resource recovery;
  • a clean environment; and
  • a carbon-neutral waste sector.

The Minister for Environment and Sustainable Development will publicly release the Strategy before the end of the year.

Long Service Leave (Portable Schemes) Amendment Bill 2011

Cabinet agreed to introduce the Long Service Leave (Portable Schemes) Amendment Bill 2011.  The Bill amends the Long Service Leave (Portable Schemes) Act 2009 to provide consistency in long service leave benefits between the portable schemes and other technical and administrative matters.

Food Amendment Bill 2011 

Cabinet agreed to introduce the Food Amendment Bill, which amends the Food Act 2001.  The amendments include a requirement for businesses issued with a prohibition order to display a closure notice at all public entrances to the business; the introduction of trained food safety supervisors in all licensed food businesses; and the creation of a public register of food businesses convicted of an offence against the Food Act.

Public Unleased Land Bill 2011

Cabinet agreed to introduce the Public Unleased Land Bill, which amends the Roads and Public Places Act 1937.  The amendments modernise the Act and create a new permit approval process for the use of public land.

Children and Young People Amendment Bill Package 

Cabinet agreed to introduce the Children and Young People Amendment Bill, which amends the Children and Young People Act 2008 with a view to strengthening and extending planning for young people transitioning from out of home care to young adulthood. 

Cabinet also agreed to table the Government Response in relation to the Select Committee Estimates, Appropriation Bill 2011-2012, in relation to Recommendation 182 concerning transition planning as part of the support and assistance for young people transitioning from out of home care. 

Work Health and Safety Legislation Amendment Bill 2011

Cabinet agreed to the Work Health and Safety Legislation Amendment Bill.  The Bill makes consequential changes to ACT legislation necessary for the effective operation of the Work Health and Safety Act 2011, which was passed by the Assembly on 23 September 2011.

Causal Vacancies on the Regional Development Australia ACT Committee.

Board of Senior Secondary Studies

Part time members to the Board of Senior Secondary Studies, subject to Sanding Committee consideration.
