Documents that are medical records are exempt under Section 6(2) of the ACT Freedom of Information Act 1989 and must be obtained under the Health Records (Privacy and Access) Act 1997. In this context, disclosure of the documents under the FOI Act is inappropriate. The applicant should be advised that applications for access to medical records must be made in accordance with the Health Records (Privacy and Access) Act 1997.
