As part of the ACT Government’s Open Government commitment, this document is a public summary of matters considered by Cabinet. It is not intended to be a detailed set of minutes and does not cover all matters considered by Cabinet. Among the matters not covered are materials considered in the formation of the ACT budget, commercial and industrial matters under negotiation as well as matters that would impact personal privacy, security and the ACT economy. Nothing in this document can be considered a waiver of the Government’s executive privilege.

Committees of Cabinet

The Expenditure Review Committee and Budget Committee of Cabinet were convened. Treasury officials joined with Ministers to discuss matters of economic and fiscal significance.

Plan of management for the Albert Hall

Cabinet agreed the Draft Albert Hall Plan of Management, which will provide a strategic plan for the management of the Albert Hall precinct including the use of the venue by the community.  The draft Plan has been developed following extensive community consultation in 2011 and 2012. The consultation summary for the draft Plan is publicly available on the Time to Talk websiteimg-icn-extlink. The plan of management will be finalised and publicly released once it is approved by the Minister for the Environment and Sustainable Development, following consideration by the Assembly Committee on Planning, Environment and Territory and Municipal Services.

Review of the Water Sensitive Urban Design General Code

Cabinet was informed of the major issues and progress on the Review of Water Sensitive Urban Design.  As part of the Government’s response to the Independent Competition and Regulatory Commission’s report on secondary water use in the ACT, the Environment and Sustainable Development Directorate was required to lead a review of water sensitive urban design regulation in the ACT.

Births, Deaths and Marriages Registration Amendment Bill 2013

Cabinet agreed the Attorney-General present the Births, Deaths and Marriages Registration Amendment Bill 2013 in the Legislative Assembly. The Bill establishes criteria for a person to be eligible to change their sex on a birth certificate. Specifically, that the requirement for a person to undergo sexual reassignment surgery be replaced with the requirement that the person believes their sex to be the sex nominated in the application and has received appropriate clinical treatment for alteration of the person’s sex or the person adduces clinical certification that they are an intersex person or a person with unspecified sex.

Cabinet agreed the Attorney-General table the revised Government Response Beyond the binary: legal recognition of sex and gender diversity in the ACT. The Government Response will be available on the Justice and Community Safety Directorate websiteimg-icn-extlink after tabling.

Road Transport (Alcohol and Drugs) Legislation Amendment Bill 2013

Cabinet agreed the Attorney-General present the Road Transport (Alcohol and Drugs) Legislation Amendment Bill 2013 in the Legislative Assembly. The Bill will implement amendments to improve the operation of the roadside alcohol and drug driving testing schemes, to enhance the safety of road users in the Territory. Courts Legislation Amendment Bill 2013

Cabinet agreed the Attorney-General present the Courts Legislation Amendment Bill 2013 in the Legislative Assembly. The Bill will implement measures designed to improve the efficiency of the Magistrates Court and the ACT Civil and Administrative Tribunal.  It will also improve ACT coronial and post mortem processes and practices.

Totalisator Bill 2013

Cabinet agreed the Minister for Racing and Gaming present the Totalisator Bill 2013 in the Legislative Assembly. The Bill will establish a robust regulatory framework for totalisator activities in the ACT.

Construction and Energy Efficiency Legislation Amendment Bill 2013 (No 2)

Cabinet agreed to presentation of the Construction and Energy Efficiency Legislation Amendment Bill 2013 (No 2) in the Legislative Assembly.  The Bill is intended to refine the operation of a range of regulations applying to construction and related work in the Territory and the Energy Efficiency Improvement Scheme.  In response to the review of ACT building quality and an ongoing review of the Building Act 2004, new offences and penalties that reflect the potential seriousness of failing to comply with the requirements for carrying out building work are proposed in the Bill.  The Bill amends the following legislation:

  • Building Act 2004
  • Construction Occupations (Licensing) Act 2004
  • Construction Occupations (Licensing) Regulation 2004
  • Electricity Safety Act 1971
  • Electricity Safety Regulation 2001
  • Energy Efficiency (Cost of Living) Improvement Act 2012

Statement of Resources to meet objectives of the Strategic Bushfire Management Plan

Cabinet agreed the Minister for Police and Emergency Services table the Statement of Resources to meet objectives of the Strategic Bushfire Management Plan in the Legislative Assembly during the November 2013 sitting period.

Appointments

Official Visitors for the Corrections Management Act

Cabinet agreed to endorse the proposed appointment of part time Official Visitors for the Corrections Management Act, subject to Standing Committee consultation.

Liquor Advisory Board

Cabinet agreed to endorse the reappointment of the following full time Liquor Advisory Board members for a period of two years:

  • Ms Caterina Giorgi
  • Mr Davis Dalrymple
  • Mr Gwyn Rees
  • Mr Josh Gray

ACT Supreme Court

Cabinet agreed to endorse the appointment of the Hon Justice Michael Wigney as an additional part-time judge to the ACT Supreme Court.
