As part of the ACT Government’s Open Government commitment, these are public summaries of matters considered by Cabinet. They are not intended to be a detailed set of minutes and do not cover all matters considered by Cabinet. Among the matters not covered are materials considered in the formation of the ACT budget, commercial and industrial matters under negotiation as well as matters that would impact personal privacy, security and the ACT economy. Nothing in this document can be considered a waiver of the Government’s executive privilege.

Government Response to Health Services Commissioner Report

Cabinet noted the Attorney General is required table the Health Services Commissioner Report ‘Investigation into the mechanical restraint of a prison detainee while being treated in a mental health facility’ in the Legislative Assembly by 10 April 2014.  Cabinet agreed the Minister for Corrections and the Minister for Health jointly present the Government response to the Health Services Commissioner’s report at the same time the Attorney General tables the Report. Changes to Extension of Time System

Cabinet agreed amendments to the Planning and Development Act 2007 and the Planning and Development Regulation 2008 to make changes to the Extension of Time System to provide for a simplified fee structure for calculating fees for Crown Leases.  The changes will take effect retrospectively from 1 April 2014.

Climate Change and Greenhouse Gas Reduction – Resource Management Plans

Cabinet reaffirmed its commitment for all ACT Government agencies to have an up to date Resource Management Plans approved by the Carbon Neutral Government Implementation Committee. Cabinet agreed that a reporting program, consistent with the Carbon Neutral Government Framework, and approved plans be implemented to ensure that demonstrable action is being taken to deliver programs that achieve targeted carbon reduction.

Planning, Building and Environment Legislation Amendment Bill 2014

Cabinet agreed to the presentation of the Planning, Building and Environment Legislation Amendment Bill 2014 which makes minor policy, technical and editorial amendments to related laws. The Bill amends the following:

  • Building Act 2004;
  • Building (General) Regulation 2008;
  • Planning and Development Act 2007;
  • Planning and Development Regulation 2008;
  • Unit Titles Act 2001; and
  • Utilities Act 2000.

ICRC (Water and Sewerage Price Direction) Bill 2014

Cabinet agreed to introduce a Water and Sewerage Price Direction Bill that will confirm the validity of the Independent Competition and Regulatory Commission price direction. Ministerial Statement on Criminal Code (Controlled Drugs) Amendment Regulation 2014

Cabinet agreed the Attorney-General make a Ministerial Statement about the amendments made to the Criminal Code Regulation 2005 to include, among other things, 39 new substances into the schedule of controlled drugs and changes the trafficable quantities of the 5 most common drugs. Statute Law Amendment Bill 2014

Cabinet agreed to introduce the Statute Law Amendment Bill 2014, which will make non-controversial, minor and technical amendments to legislation under the technical amendments program. The Bill amends the following laws:

  • Corrections Management Act 2007;
  • Cultural Facilities Corporation Act 1997;
  • Dangerous Substances Act 2004; and
  • Work Health and Safety Act 2011.

Aboriginal and Torres Strait Islander Elected Body Amendment Bill 2014

Cabinet agreed to introduce the Aboriginal and Torres Strait Islander Elected Body Amendment Bill 2014 that will allow the commencement of the 2014 Aboriginal and Torres Strait Islander Elected Body elections to coincide with National Aborigines and Islanders Day Observance Committee (NAIDOC) Week.
