C.5 Internal Accountability


Organisation Structure 

On 10 November 2012, the Chief Minister and Cabinet Directorate was renamed the Chief Minister and Treasury Directorate.  In addition to retaining all the functions previously held as the Chief Minister and Cabinet Directorate, the Chief Minister and Treasury Directorate assumed responsibility for the staff and functions relating to budget process and financial reporting, taxation and revenue policy, fiscal and economic policy (including competition and regulatory reform), insurance policy and borrowing and funds management from the Treasury Directorate and the Injury Management and Safety Unit from Shared Services.

Director-General and Head of Service - Andrew Cappie-Wood 

The Director-General is responsible for the efficient administration of the Directorate and its strategic direction.  The Director-General of CMTD is also the Head of Service and in this role chairs the Strategic Board (constituted of all ACT government agencies Directors-General) which provides whole of government leadership and strategic direction to the ACTPS.

Deputy DIrector-General, Policy and Cabinet (Output 1.1) - Ms Pam Davoren

The Policy and Cabinet Division provides advice and direction across the ACTPS on complex policy matters, incorporating a central agency coordination role in strategic planning, social and economic policy, spatial planning, regional policy and strategy, and across government information and ICT strategy.

The Division supports the Chief Minister, Cabinet and the Director-General as Secretary of Cabinet, through the provision of policy and support, including Cabinet secretariat functions.  The Division also has a role in providing secretariat support to the ACTPS Strategic Board.

It supports the Chief Minister and represents the ACT at intergovernmental fora, notably COAG and CAF.  The Division manages and coordinates the ACT's relationships with other jurisdictions, most significantly with the Australian and NSW Governments and local councils in the region.

Director, Cabinet and Intergovernmental Relations Branch (Output 1.1) - Mr Dave Peffer

The Cabinet and Intergovernmental Relations Branch provides across government coordination and secretariat services to the Chief Minister and the Director-General to support Cabinet and the Strategic Board.  It facilitates the passage of Government business in the Legislative Assembly, provides advice and coordination for the ACT's intergovernmental relations and administers a number of associated ACT laws.

Director, Economic, Regional and Planning Branch (Output 1.1) - Mr Brook Dixon

The Economic, Regional and Planning Branch provides across government strategy, policy coordination and advice to the Chief Minister and the Director-General on a range of issues including strategic planning; performance and accountability arrangements; economic policy; environmental policy; spatial development of the Territory; sustainability projects; and Canberra's role as a regional centre in south-eastern NSW.

Director, Social Policy and Implementation Branch (Output 1.1) - Mr Geoffrey Rutledge

The Social Policy and Implementation Branch is responsible for undertaking research and providing strategic social policy on current and emerging issues and initiatives at the local and national level. It provides across government advice on promoting improved social outcomes.  The Branch also provides across government implementation and related policy advice, in particular on the Canberra Plan Framework, the Canberra Social Plan and other across government strategies.

Executive Director, Government Information Office (Output 1.1) - Mr Mick Chisnall

The Government Information Office is responsible providing across government advice and coordination on ICT issues and release of government information.  It has a role in delivering the ACT Government's commitment to Open Government and supports innovation in the use of web 2.0 technologies across government.

The Office works in partnership with other ICT areas and draws on expertise from across the ACTPS to deliver projects.

Chief Finance Officer, Strategic Finance Branch - Mr Paul Ogden

The Strategic Finance Branch is responsible for the financial and budgetary management of CMTD and the ACT Executive.  This includes budget strategy and development, strategic financial monthly and annual reporting, and support for the Ministers, Executive Management Group, senior management and the internal audit function.  The team undertakes day-to-day accounting and reporting activities to meet the needs of business units and external reporting obligations.

Internal Audit Manager - Mr David Morgan

Internal Audit is an independent assurance and consulting activity that reviews and evaluates the effectiveness of the Directorate's risk management, internal control, and governance practices.  (See Internal Audit under section C.1 of this report.)

Deputy Director-General, Workforce Capability and Governance Division and Commissioner for Public Administration (Outputs 1.2 and 1.3) – Mr Andrew Kefford 

The Workforce Capability and Governance Division is responsible for ACTPS employment legislation and conditions.  It provides advice to Government and develops policy and legislation in areas involving the relationship between employers and workers in the ACT; including industrial relations, work health and safety and workers' compensation.

The Division also provides support to the Head of Service, the Commissioner for Public Administration, the ACTPS Strategic Board and its sub-committees, and supports the ACT's participation in intergovernmental fora on workplace relations and work health and safety issues.

Director, Public Sector Management Group (Output 1.2) – Ms Liesl Centenera

The Public Sector Management Group provides a central agency policy and advisory role for ACTPS employment and conditions; industrial relations issues; human resources planning and management; accountability; and learning and development issues and programs.

The Group also provides support to the statutory office of the Commissioner for Public Administration, the ACT Remuneration Tribunal (the independent statutory tribunal with responsibility for setting the remuneration, allowances and entitlements for various public officials in the ACT), the ACTPS Joint Council (the ACT Public Service union-management consultative forum) and the People and Performance Council (the senior body for consideration of workforce capacity and capability and workforce performance issues).

Director, Enterprise Agreement Negotiations Group (Output 1.2) – Mr Russell Noud (Acting) 

The Public Sector Workplace Relations Group provides advice to Government and directorates on ACTPS workplace relations matters.  This includes advice on wage policy, industrial relations dispute policy and enterprise agreement negotiation strategy.  The Group also provides ad hoc advice and interpretation on ACTPS enterprise agreement and industrial award content.

The Group negotiates common terms and conditions aspects of all ACTPS and Legislative Assembly Members' Staff (LAMS) enterprise agreements for Government and undertakes the secretariat function to the ACTPS Joint Council.

Director, Office of Industrial Relations (Output 1.3) – Ms Heidi Robinson (Acting)

The Office of Industrial Relations is responsible for developing policy and legislation on a range of matters concerning workplace relations.  These include industrial relations, work safety including dangerous substances and asbestos regulation, and public holidays and daylight saving.

The Office also provides support for the ACT's contribution to the national harmonisation of work health and safety, including through participation as the ACT's representative in the Workplace Relations Ministers' Council and by providing secretariat support to the ACT Work Safety Council and the Territory's representatives on the Safe Work Australia Council and its sub-committees.

Director, Continuous Improvement and Workers' Compensation Branch (Outputs 1.2 and 1.3) – Ms Meg Brighton 

The Continuous Improvement and Workers' Compensation Branch is responsible for the management of the ACT Private Sector Workers' Compensation Scheme, including policy, legislation and the supervision of the ACT Default Insurance Fund.

It manages the ACT government accident and incident data repository, and is responsible for the management and prevention of workplace injuries in the ACTPS, including the management and delivery of return-to-work and injury management programs for the ACT government and the provision of health and safety consultancy services and safety system improvement programs to directorates.  It is responsible for the development and implementation of the ACTPS Workers' Compensation and Work Safety Improvement Plan.

The Branch also provides support for the ACT's contribution to the national harmonisation workers' compensation laws.

Director, Corporate Management Branch – Ms Sue Hall 

The Corporate Management Branch provides a range of strategic, governance, organisational development, administrative and human resource functions for the Chief Minister and Treasury Directorate and the Director is also the CMTD SERBIR.

Executive Director, Culture and Communications (Output 1.4) – Mr Jeremy Lasek 

The Culture and Communications Division is responsible for Directorate and across government communications, community engagement polices, branding, and providing public affairs advice and planning.  It is also responsible for the delivery of the Centenary of Canberra Program in 2013.

The Division coordinates briefs and ministerials for the Chief Minister, provides advice on protocol, manages hospitality and special events for the Chief Minister, and provides support for members of the ACT Executive (the Chief Minister and other Ministers) and their staff.  The Division also provides secretariat services to the Director-General for ACT and national honours and awards.

Under Treasurer – Mr David Nicol

The Under Treasurer is responsible for the provision of strategic financial and economic policy advice to the Government with the aim of promoting the Territory's financial position and economic management.  The Under Treasurer also plays a leading role in promoting accountability and transparency in the delivery of services to the community.

Executive Director, Investment and Economics Division (Output 2.1) – Karen Doran

The Investment and Economics Division is responsible for providing analysis and advice to the Government and agencies on economic and regulatory reform, facilitating appropriate intergovernmental financial arrangements, management of the Government's financial assets and liabilities, including superannuation liabilities and investments and insurance policy.

Director, Economics Branch (Output 2.1) - Mr Brett Wilesmith (Acting)

The Economics Branch is responsible for monitoring and reporting on the state of the ACT economy, preparing economic and revenue forecasts, examining policy issues, and assisting agencies to develop and assess policies within a framework that promotes the productivity and competitiveness of the ACT economy.

The Branch also provides policy advice and economic analysis on microeconomic issues, with a focus on competition and regulatory policy, tax reform and sectoral economic matters.

Director, Investment Branch (Output 2.1) – Mr Patrick McAuliffe 

The Investment Branch is responsible for the management of the Territory's financial assets and liabilities, the investment and borrowing activities of the Government, and management of the Territory Banking Account (the public account of the ACT Government).  The TBA separately recognises, and accounts for, general Government investments, Territorial revenues and budget appropriation transfers made to agencies.

The Branch also manages the unfunded employer superannuation liabilities of the Territory.  This includes the establishment of investment policies and management of investment activities of funds set aside in the Superannuation Provision Account to meet the unfunded employer superannuation liabilities.

Director, Legal and Insurance Policy Branch (Output 2.1) – Mr Tom McDonald 

The Legal and Insurance Policy Branch is responsible for insurance policy and across government risk policy, including development of policies concerning integrated or enterprise across government risk and insurance.

The Branch is also responsible for the regulation and administration of the ACT Compulsory Third-Party Insurance Scheme.  This scheme indemnifies the drivers of all registered motor vehicles in the ACT against the cost of personal injury negligently occasioned to people as a result of a motor crash.

The Branch has responsibility for carriage of all liability claims and management of entitlement assessments and payments arising out of the purported failure by the ACT Government and its entities to provide proper superannuation benefits to certain qualified temporary, permanent, and former employees of ACT Government and related entities.

Executive Director, Finance and Budget Division (Output 2.2) – Mr Neil Bulless

The Finance and Budget Division is responsible for advising the Government and agencies on the development of the Territory's Budget; financial issues relating to agencies and the Territory; and accounting policies and financial frameworks.

Director, Budget Management and Analysis Branch (Output 2.2) – Ms Nicole Masters 

The Budget Management and Analysis Branch is responsible for assisting in the development of the Territory's annual budget; monitoring, analysing and reporting to the Government and other stakeholders on the financial position of a broad range of Government agencies and businesses; and advising Government and agencies on financial management, resource allocation, and budget development issues.

Director, Budget Coordination and Reporting Branch (Output 2.2) – Ms Trish Drury 

The Budget Coordination and Reporting Branch is responsible for providing strategic advice on the Government's financial position, the coordination and development of the Government's budget and supplementary budgets, the development of the budget review and the consolidation of budget financial statements and financial outcome reporting.

The Branch provides periodic reporting to the ABS and the Commonwealth Grants Commission on behalf of the Government.

The Branch also distributes Chief Minister and Treasury Directorate financial memoranda that provide advice to agencies across government on various financial issues.

Director, Infrastructure and Budget Management Branch (Output 2.2) – Mr Floyd Kennedy (Acting)

The Infrastructure and Budget Management Branch is responsible for coordinating the development and ongoing monitoring of the Territory's Capital Works Program, and across government asset management policies.  It is also responsible for assisting in the development of the Territory's budget, and analysing and reporting on agency and business financial performance, and resource allocation.

Director, Accounting Branch (Output 2.2) – Ms Lisa Holmes

The Accounting Branch is responsible for improving the Territory's financial management framework and providing accounting expertise and strategic financial advice.  The Branch also has responsibility for undertaking significant amendments to the Financial Management Act 1996, providing financial training to agencies, and issuing relevant financial instructions across government.

Director, Expenditure Review Division (Output 2.2) – Mr Stuart Friend

The Expenditure Review Branch is responsible for expenditure review activities on specific services and functions as determined by the Government.  It also undertakes broader across government reviews on discrete areas of activity or spending as requested.

Executive Remuneration 

All executives employed by the Directorate are paid in accordance with Determinations of the ACT Remuneration Tribunal and relevant laws and instruments, including the Public Sector Management Act 1994 and the Public Sector Management Standards 2006.

Audit and Risk Committee (Further details are available in C.1 Risk Management and Internal Audit The Audit and Risk Committee assists the Director-General in fulfilling his oversight and governance responsibilities.  The Committee's functions are governed by an Audit and Risk Committee Charter.  Membership includes appointees from the Directorate and an independent Chair.  Observers and a representative from the ACT Auditor-General's Office also regularly attend meetings. 
Health and  Safety Committee (Further details are available in C.9 Workplace Health and Safety Committee The Committee provides a way for management and workers to meet regularly and discuss workplace health, safety and wellbeing matters.

In accordance with Division 5.4 Section 77 of the Work Health and Safety Act 2011 the functions of the HSC are:

  • to facilitate cooperation between the person conducting a business or undertaking and workers in instigating, developing and carrying out measures designed to ensure the workers' health and safety at work;
  • to assist in developing standards, rules and procedures relating to health and safety that are to be followed or complied with at the workplace and;any other functions prescribed by regulation or agreed between the person conducting the business or undertaking and the Committee.
The Committee consists of employee and management representatives, and an agreed Chairperson.  Corporate Management provides secretariat support.  Members represent Work Groups which are located at:

Workplace Consultative Committee (WCC)  The Chief Minister and Cabinet Directorate Enterprise Agreement 2011-2013 provides for the establishment of a WCC.

Key objectives of the WCC are to:

  • monitor the operation and implementation of the Agreement;
  • consider any proposed new or significant changes to Directorate policy statements and guidelines that relate to the provisions of the Agreement;
  • exchange information about workplace issues affecting employees; andconsult on any existing performance management schemes, and on the development of any new performance management schemes, in the Directorate.
WCC consists of employee and management representatives.  Corporate Management provides secretariat support.The role of Chairperson alternates between CMTD management representatives and the Union as agreed by the WCC.
IMCT Committee  The Committee formulates and seeks Executive Management Group endorsement of policies, strategies, standards and plans that are consistent with and support the implementation of, and compliance with, Government-wide IMCT policies, strategies, plans and standards.

The role of the committee is to provide a Directorate forum to:

  • engage in discussions on IMCT matters;
  • ensure the management of IMCT governance across CMTD;
  • develop and endorse CMTD IMCT specific policies and processes; and
  • engage with Shared Services ICT at a strategic level on CMTD specific matters.

Key Corporate and Operational Plans

Chief Minister and Cabinet Directorate Corporate Plan 2012-13

The Corporate Plan 2012-13 details the Directorate's purpose, vision, values, stakeholders, strategic objectives, planning framework, organisational environment, governance framework and priorities for 2012-13.  The plan provides an internal framework for subordinate divisional business plans and is reviewed and updated annually.

Chief Minister and Treasury Directorate Risk Management

Chief Minister and Treasury Directorate Fraud and Corruption Prevention Plan

The objective of the CMTD Fraud and Corruption Prevention Plan is to provide the basis of CMTD's actions to control fraud and to identify those key activities performed by CMTD that require the implementation of additional controls to reduce the likelihood of fraud occurring against the program.  The plan provides an overview of the fraud control framework, the role and functions performed by CMTD, including its purpose, objectives and goals; organisational arrangements; and its resources utilisation.

Against this background, the plan analyses the exposure of CMTD to fraud and, using a control self-assessment framework, assesses the existing controls implemented to minimise fraudulent activity.

This plan was reviewed following the AAs to take into account changes to the Directorate's structure, responsibilities and operating environment.

Business Continuity Plan

The Business Continuity Plan includes an analysis of potential risks for the Directorate, business impacts and risk management strategies.  Problems that could cause interruptions to the Directorate's services include accommodation issues, computer systems, telecommunications systems, personnel, information or external service providers.

The plan outlines a role-based approach, documenting the management structure, staffing, team roles and responsibilities and actions that are to be implemented after a major incident.

Work was undertaken during the reporting period to update the Business Continuity Plan.

Audit Program

The Directorate has a three-year audit program that is prepared on a risk analysis basis and identifies areas of high, medium and low risk.  The Audit and Risk Committee oversights the audit function, approving the work program and reviewing all internal audit reports and annual financial statements.  Further information on the audit functions is provided in section C.1 Risk Management and Internal Audit.

Chief Minister and Treasury Directorate People Plan

The People Plan identifies aims and objectives in relation to the management of human resources in order to facilitate achievement of the Directorate's strategic objectives.  Annual people priorities form part of the plan including implementation of ACTPS policy and initiatives.

Regular reports on People Plan priorities are provided to the Workplace Consultative Committee, Health and Safety Committee and the Executive Management Group for review.

Chief Minister and Treasury ICT Strategic Plan

The ICT Strategic Plan provides guidance on areas for focus to enable the Directorate to better respond to changing business and community needs in the digital world.

A CMTD ICT Committee oversights the implementation of the ICT Strategic Plan and provides regular reporting to the Executive Management Group.  This includes reviewing progress and identifying priorities for inclusion in the annual Action Plan. This plan is currently under review.

Chief Minister and Treasury Information Management Framework

The development of an Information Management Framework was identified as an outcome in the CMTD ICT Strategic Plan.  The Framework aims to assist the Directorate to better align to government strategies and assist in mapping out where improvements are required in the creation, dissemination control, retention and destruction of information.  The ICT Committee monitors the implementation of actions in the framework. 

Chief Minister and Treasury Directorate Resource Management Plan

The Resource Management Plan provides guidance for addressing sustainability issues in the Directorate with the aim of improving our environmental resource efficiency, and incorporating sustainability into day-to-day operations.

The plan and associated annual Action Plan focus on strategies to better measure and improve our resource management in the key areas of: energy and water consumption, waste production and recycling and reduction initiatives, office products, and staff engagement in resource management issues.
